BREAKING: Most of Mexico’s Lawfare Suit Against US Gunmakers Dismissed…Again

A federal District Court judge in Boston has tossed most of the $10 billion lawsuit filed by the government of Mexico against a group of US firearm manufacturers. Judge Dennis Saylor tossed the suit against six of the eight respondents on jurisdictional grounds.

This isn’t the first time Judge Saylor tossed Mexico’s attempt to extort cash from us gun companies. Back in 2022, he threw out the suit on the grounds that it violated the Protection of Lawful Commerce in Arms Act. As the AP reported at the time . . .

The law shields gun manufacturers from damages “resulting from the criminal or unlawful misuse” of a firearm.

“While the court has considerable sympathy for the people of Mexico, and none whatsoever for those who traffic guns to Mexican criminal organizations, it is duty-bound to follow the law,” Saylor wrote.

Earlier this year, however, the First Circuit Court of Appeals reinstated the suit. The Court ruled that despite clear PLCAA problems, Mexico’s suit “plausibly alleges a type of claim that is statutorily exempt from the [act’s] general prohibition.”

Today, however, Judge Saylor has once again dispatched most of the action against the US gun makers.

    1. Nothing got stayed. Just some of the defendants were dismissed from the case by the trial court on jurisdictional grounds (the nature of which grounds are not explained by the short article here).
