Defending the gun charges (against Hunter Biden), (special counsel David) Weiss argued that “the Second Amendment, like the rest of the Constitution, ‘protects against invasions of individual rights; it is not a suicide pact.'” He added that “Congress’s legislative choice to prohibit individuals who are actively engaged in habitual illegal or compulsive narcotic use from possessing firearms falls firmly within longstanding historical traditions and accords with the Second Amendment.”

Notably, Biden sided with Weiss in this constitutional dispute, which pitted the president against his own son. The Biden administration has stubbornly defended Section 922(g)(3) in one case after another, specifically arguing that cannabis consumers are so untrustworthy and dangerous that the government is justified in threatening them with prison if they dare to exercise their Second Amendment rights.

President Biden not only supports that policy; he evidently thought the penalties that his son faced for violating it were not severe enough. The Bipartisan Safer Communities Act, which Biden signed in June 2022, increased the maximum sentence for violating Section 922(g)(3) from 10 to 15 years. It also created yet another possible charge for drug users who obtain firearms, likewise punishable by up to 15 years in prison. If Hunter Biden had bought his revolver after that law took effect and was still using crack, he could have faced four felony charges with a combined maximum penalty of 45 years.

Joe Biden nevertheless argues that his son did not deserve a prison sentence for illegally obtaining a firearm. Those severe penalties, he implies, are meant for other defendants, people who actually pose a threat to public safety. That position seems inconsistent with the Biden administration’s insistence that every cannabis consumer—including patients who use marijuana as a medicine with state approval—is a public menace.

In any case, (Patrick Darnell) Daniels got almost four years based on nothing more than his status as a gun-owning cannabis consumer. While Hunter Biden is a well-connected man who could afford top-of-the-line legal representation, Daniels is a man of much more modest means with decidedly less political influence. The contrast between their cases is not a good look for a president who periodically decries the unjust and unequal impact of marijuana prohibition.

  1. Anyone who ever thought that Biden was anything other than a liar since he started in congress is way out of touch with reality.

    He dodged the draft using asthma as a deferment, didn’t stop him from playing sports in college though. Shows what a coward he is!

    His career was spent enriching himself, his brother and his son. Look how many millions of dollars accrued to them while he was in congress and the oval office. His drug using lying son got millions sitting on the board of a Ukrainian company that he had nothing to support his being there other than serving as a connection to his daddy.

    Anyone who can support lying Joe, who repeatedly stated that he would not pardon his son, who was found guilty during a jury trial and plead guilty in his tax evasion case is a big a idiot lying Joe and the rest of his family! He will go down in history as the most corrupt, lying and unscrupulous president in US history! Even worse than slick Willy.

  2. The Democr4atic Party and it’s leadership are without a doubt, the biggest threat to American’s freedom. Be it speech, guns or any other right, they want to take them away. Wasn’t it King Obama that wanted to tear up the Constitution and re-write it to better fit the Left’s agenda?

  3. Joey bidet has been a vile, disgusting pig his entire career. No one with a lick of common sense should be at all surprised that he pardoned hunter. He was always going to do that. Come on, joey isn’t capable of telling the truth. It’s only because of his dementia that occasionally the truth slips out unintentionally.

  4. You left out the biggest area of Biden’s hypocrisy – and there are so many. The Crime Bill that he sponsored in 1994 carried stiff penalties for using crack – and Biden was very proud of it. He posed for the cameras and said in effect – “I don’t care if you had a difficult childhood or grew up in drug-infested neighborhoods. I care more about my mother and grandmother getting beaten or robbed by someone wanting drugs. So, if you use this much crack (and he held his hand up with almost no space between his finger and thumb), you’re going to jail – no exceptions. Except of course for his own 54-year old little boy who filmed himself using tons of crack with hookers. Little Hunter isn’t going to jail.
